Under a Chapter 7 filing, you are allowed to discharge certain debts in exchange for the sale of assets. Certain debts, such as tax obligations, may be exempt from discharge. Specific assets, including real property, motor vehicles and retirement assets, may be exempt from sale.
The bankruptcy laws changed in 2005, with the adoption of BAPCPA (Bankruptcy Abuse Prevention and Consumer Protection Act), making it much more difficult for some individuals to discharge debts through a Chapter 7 filing. Under the new law, you must submit to a means test, whereby the bankruptcy court determines whether you have the ability to repay your debts over a 3 to 5 year period. If the court determines you have the means, your most probable bankruptcy option is to file for a restructuring of your debt under Chapter 13 Bankruptcy law.
