Arizona Bankruptcy Attorney - Gilbert, Arizona

Chapter 7 • Chapter 13 • Foreclosures • Debt Negotiation

Bankruptcy can happen to anyone and under many different circumstances. Although filing for bankruptcy can be a frightening thought, it is important to know that you have resources available to help you. I devote my practice to helping individuals who are facing bankruptcy due to a number of factors, including:

  • Job loss
  • Subprime mortgage debt
  • Illness
  • Debt mismanagement
  • Divorce and other family needs

Bankruptcy and Foreclosures

If you are facing foreclosure on your home as a result of the subprime mortgage crisis, you may be considering personal bankruptcy as a way of keeping your home. You may be uncertain how the new bankruptcy laws apply and whether your home will be protected from liquidation in a Chapter 7 filing. You want a lawyer who fully understands the bankruptcy laws, who will help you determine your options and who will ensure that your interests are protected if you choose to file bankruptcy.

Chapter 7 Bankruptcy Liquidation vs Chapter 13 Bankruptcy Reorganization

I have experience providing counsel to clients who have decided to file for protection under Chapter 7 or Chapter 13 of the federal bankruptcy laws. I will help you determine whether a personal bankruptcy filing is the best way to avoid foreclosure or stop threatening letters and legal action. Contact me to set up a free initial consultation.

Under a Chapter 7 filing, you are allowed to discharge certain debts in exchange for the sale of assets. Certain debts, such as tax obligations, may be exempt from discharge. Specific assets, including real property, motor vehicles and retirement assets, may be exempt from sale.

The bankruptcy laws changed in 2005, with the adoption of BAPCPA (Bankruptcy Abuse Prevention and Consumer Protection Act), making it much more difficult for some individuals to discharge debts through a Chapter 7 filing. Under the new law, you must submit to a means test, whereby the bankruptcy court determines whether you have the ability to repay your debts over a 3 to 5 year period. If the court determines you have the means, your most probable bankruptcy option is to file for a restructuring of your debt under Chapter 13 Bankruptcy law.

When you come to me for bankruptcy counsel, I will help you determine, before you file, whether you will meet the means test. If you qualify for a Chapter 7 liquidation, I will work with you to identify those debts that cannot be discharged, as well as those assets that are exempt from sale.

If you have determined that filing for protection under the bankruptcy laws is the best way to avoid foreclosure or to stop harassing calls from creditors, contact my office to schedule a free initial consultation. I maintain flexible hours and will meet with you at your convenience by appointment.
